National Nurses Week E-Gift Card Sweepstakes Official Rules

American Nurses Association (“ANA”) is sponsoring a sweepstakes to celebrate its members and the National Nurses Week (“Sweepstake”). The 10 lucky winners of the Sweepstakes will each receive a $50 gift card to spend on the National Nurses Week e-store.

Sweepstake Period: This members-only Sweepstake will take place April 1 – April 20, 2019, subject to change at ANA’s discretion. 

Eligibility: Sweepstakes may only be entered by current ANA members. You must be a legal resident of the 50 United States or the District of Columbia and be at least 18 years of age or older (19 in AL/NE) at the time of entry. Directors, officers, employees, contractors, and/or agents of the American Nurses Association and/or any of its subsidiaries are not eligible to participate.

To Enter: All ANA members who sign up for one or all of the Navigate Nursing webinars will be automatically entered into the Sweepstakes.

By not opting out of the Sweepstakes, each participant fully and unconditionally agrees to and accepts these Official Rules and the decisions of ANA, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. No exceptions or substitutes will be made.

Prizes: Each of the lucky winners will receive one $50 National Nurses Week e-Store Gift Card. Limit one prize per participant. Winners will be selected in a random drawing from eligible entries by ANA. Odds of winning will depend on the number of eligible entries received. Winner(s) will be notified by email within five (5) business days after the drawing date (“Notification”). The winner(s) will have thirty (30) business days from receipt of Notification to claim their prize. Prizes not won or claimed by an eligible winner in accordance with these Official Rules will not be awarded and will remain the property of the ANA.

Upon entry into the Sweepstakes, winners are required to comply with any and all applicable federal, state and local laws, rules and regulations. All federal, state and local taxes, and any other costs not specifically provided for in these Official Rules are solely the winner’s responsibility. Prizes are not assignable.

Rights granted to ANA: Except where prohibited, by entering the Sweepstakes you irrevocably agree that ANA and their affiliates and their respective assigns, agents and licensees (collectively, the “ANA Parties”) may use your name, likeness, voice, photograph and any statements regarding your participation in Sweepstakes (collectively, “Your Likeness”) throughout the world, in perpetuity, in any media, without limitation or compensation to you. By entering the Sweepstakes, you permanently waive all intellectual property rights, privacy/publicity rights and other legal or moral rights that might preclude the ANA Parties’ use of Your Likeness, and you agree not to sue or assert any claim against the ANA Parties (or any of them) in connection with their use of Your Likeness.

General Conditions/Release: By entering the Sweepstakes, participants (a) release the ANA Parties from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of a prize; and (b) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to the prizes including, but not limited to, their quality or availability, or suitability.

The ANA Parties will not be responsible for typographical, printing, or other inadvertent errors in these Official Rules or other materials or announcements relating to the Sweepstakes or for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost/delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any on-line service or Website, or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost or misdirected mail, or any injury or damage to participant’s or any other person’s computer related to or resulting from participation in this Sweepstakes.

ANA reserves the right to disqualify anyone found to be tampering with or otherwise abusing any aspect of the Sweepstakes, as determined by ANA at its sole discretion. ANA, at its sole discretion, reserves the right to cancel, terminate, modify or suspend the Sweepstakes if tampering, viruses, bugs or other causes beyond their reasonable control corrupt the administration, security, fairness or proper operation of the Sweepstakes. Should the Sweepstakes be terminated prior to the stated end date, ANA reserves the right to select winners from among the submissions entered prior to the early termination date.

ANA reserves the right not to award any or all part of the Prizes, or to cancel, terminate, modify, extend or suspend the Sweepstakes without liability in the event an insufficient number of eligible entries are received.

Disputes: By entering the Sweepstakes participants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Maryland; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances will participants be permitted to obtain for, and each participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, participants’ rights and obligations, or the rights and obligations of ANA in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of Maryland, without giving effect to any choice of law or conflict of law rules (whether of the state of Maryland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other the state of Maryland.
